By accessing or using the website 42creativehub.com (the "Site"), you ("you" or "User") agree to be bound by these Terms and Conditions ("Terms"). Please read these Terms carefully before using our Site or engaging our services. If you do not agree to these Terms, you must not access or use the Site. 

1. Use of the Site

1.1. Lawful Use

You agree to use the Site in a lawful manner and in accordance with all applicable laws and regulations in Ireland and any other jurisdiction from which you access the Site.

1.2. No Disruption

You agree not to engage in any activity that could disrupt, damage, disable, overburden, or impair the proper functioning or security of the Site or interfere with other users' access to or use of the Site. This includes, but is not limited to, transmitting viruses, malware, or any other harmful code.

1.3. Account Responsibility (if applicable)

If any part of the Site requires you to create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account. 

2. Services Offered

2.1. Description of Services

42 Creative Hub™ provides the following services (collectively, the "Services"):

a. Consulting as a Service (CaaS)

Strategic, digital-first consulting engagements delivered remotely, including (but not limited to):

• Digital Transformation strategy sessions

• Future-Ready IT planning

• Design Thinking facilitation

• Custom Notion template creation and workspace setup

b. Notion Templates & Resources

Providing downloadable or shareable digital templates, systems, and productivity tools for use within the Notion platform.

c. Web Design Services

Digitally delivered creative work including:

• UI/UX mockups

• Website prototypes

• Other assets sent electronically

d. Blog Content & Digital Resources

Providing freely accessible informational and engaging articles, resources, and perspectives on subjects encompassing the latest technologies, digital transformation, and the digital landscape. Accompanying downloadable guides, eBooks, or exclusive subscriber content are considered separate digital products subject to the terms outlined herein.

e. Digital Services

• Online Courses or Webinars: Pre-recorded educational content delivered via digital platforms.

• Remote Creative Services: Such as branding packages, logo designs, digital strategy documents, and other creative assets delivered electronically.

• Downloadable Resources: eBooks, design files, toolkits, or guides provided in digital formats (PDF, HTML, etc.).

• Digital Tools & Automation: Custom-built Notion setups, automation scripts, or integrations designed for productivity and business efficiency. Please note that access to and functionality of certain automation features within Notion workspaces require a paid Notion subscription (e.g., Notion Plus or higher) by the client. We are not responsible for subscription fees or any limitations imposed by the client's Notion plan.

2.2. Additional Terms

Specific Services may be subject to separate agreements or additional terms and conditions provided to you at the time of engagement. In the event of a conflict between these general Terms and any specific service agreement, the terms of the specific service agreement will prevail.

2.3. No Guarantees

While we strive to provide valuable and effective Services, we do not guarantee specific outcomes or results from the use of our Services. The success of any consulting advice or web design project depends on various factors, many of which are outside our control.

3. Intellectual Property Rights

3.1. Our Content

All content on the Site, including but not limited to text, graphics, logos, images, videos, audio clips, data compilations, software, and the design, layout, and appearance of the Site (collectively, "Our Content"), is owned by 42 Creative Hub™ or its licensors and is protected by copyright, trademarks, database rights, and other intellectual property laws in Ireland and internationally, unless otherwise stated.

3.2. Your Use of Our Content

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use Our Content solely for your personal, non-commercial use in connection with browsing the Site and utilizing our Services as intended.

3.3. Prohibited Activities

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of Our Content without the prior written consent of 42 Creative Hub™, except as expressly permitted by these Terms or other applicable agreements. Unauthorized reproduction is strictly prohibited.

3.4. Client Content (for Web Design)

For web design services, any content you provide to us (e.g., text, images, logos) remains your intellectual property. You grant 42 Creative Hub™ a non-exclusive license to use, reproduce, modify, and display such content solely for the purpose of providing the agreed-upon web design services. 

4. Limitation of Liability

4.1. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to warranties of accuracy, completeness, reliability, suitability, availability, or non-infringement. We do not warrant that the Site will be error-free or that access to the Site will be uninterrupted.

4.2. No Guarantee of Results

We do not guarantee any specific results or outcomes from the use of our Site, the information provided on our blog, or our consulting and web design Services. Any testimonials or examples provided on the Site are for illustrative purposes only and do not constitute a guarantee.

4.3. Use at Your Own Risk

Your use of the Site and any reliance on its content or our Services is at your sole risk.

4.4. Exclusion of Certain Damages

To the maximum extent permitted by applicable law, 42 Creative Hub™ and its owner(s), employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses) arising out of or in connection with your use of the Site, our Services, or these Terms, even if we have been advised of the possibility of such damages.

4.5. Maximum Liability

To the maximum extent permitted by applicable law, our total aggregate liability to you for any and all claims arising out of or in connection with your use of the Site or our Services shall be limited to the amount you paid for the specific service in question.

4.6. Consumer Rights

Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable Irish consumer protection laws. 

5. Indemnification

You agree to indemnify, defend, and hold harmless 42 Creative Hub™ and its owner(s), employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms, your use of the Site, or your violation of any law or the rights of a third party. 

6. Changes to These Terms

6.1. Right to Modify

We reserve the right to modify or update these Terms at any time without prior notice. Any changes will be effective immediately upon posting the revised Terms on the Site.

6.2. Continued Use Constitutes Acceptance

Your continued access to or use of the Site after the posting of any revised Terms constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically for any changes. The "Last updated" date at the top of this page indicates when the Terms were last revised.  

7. Governing Law and Jurisdiction

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising out of or in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Ireland.  

8. Entire Agreement

These Terms constitute the entire agreement between you and 42 Creative Hub™ with respect to your use of the Site and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us.  

9. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms shall remain in full force and effect, and the invalid or unenforceable provision shall be deemed to be replaced by a valid and enforceable provision that most closely matches the intent of the original provision.
