Cancellation and Refund Policy

This Cancellation and Refund Policy governs purchases of digital products and consulting services offered by 42 Creative Hub™ through its website, 42CreativeHub.com.

  1. Right of Withdrawal (EU & Irish Consumer Rights)

    Pursuant to the EU Consumer Rights Directive (2011/83/EU) and applicable Irish law, consumers generally have a 14-day right to withdraw from distance contracts. However, this right is subject to specific exceptions, particularly concerning digital content and services where access or performance has commenced with the consumer's consent.

  2. Digital Products

    2.1. Software Licenses (via Third-Party Reseller)

    The cancellation and refund terms for software licenses purchased through our third-party reseller are subject to the reseller's specific policies. Please refer to the reseller's terms and conditions provided at the time of purchase. 42 Creative Hub™ is not directly responsible for the cancellation or refund of these licenses.

    2.2. Design Templates, Newsletter, and Blog Posts

    By purchasing design templates, newsletter subscriptions, or individual blog posts, the consumer expressly consents to the immediate provision of access to the digital content. Once access has been granted, downloaded, or otherwise made available, the right of withdrawal is waived, and no refunds will be provided. This policy is in accordance with Article 16(1)(m) of the Consumer Rights Directive, which exempts the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer’s prior express consent and their acknowledgment that they thereby lose their right of withdrawal. You may cancel your order and receive a full refund before accessing the digital product. Refunds will only be considered if the product is demonstrably defective or materially fails to conform to the agreed-upon description.

    Furthermore, 42 Creative Hub™ shall not be liable for any failure of the digital product to function correctly, nor shall refunds or remedies be provided, if such failure arises due to modifications, alterations, or any part being changed or cancelled by the customer after the product has been successfully delivered.

  3. Consulting Services

    3.1. Web Development Consultation, Digital Transformation, Security Compliance

    Consumers may cancel a consulting service within 14 days of the contract's conclusion, provided the service has not yet commenced. Should the consumer explicitly request the commencement of services within the 14-day withdrawal period, they shall be liable for a proportionate payment for the services supplied up to the point of withdrawal.

    3.2. Courses for Customer's Employees

    Cancellation of employee training courses is permitted up to 5 hours before the scheduled commencement date, subject to an administrative fee of [Specify Percentage or Fixed Amount] of the total course fee. Cancellations made with less notice may not be eligible for a refund.

    3.3. Flexible Rescheduling

    Recognizing the dynamic nature of business needs, we offer a degree of flexibility in rescheduling consulting sessions and employee training courses. Requests for rescheduling must be made at least 3 hours in advance of the scheduled time and are subject to availability. Excessive rescheduling may incur additional charges at our discretion.

    3.4. Refunds for Consulting Services

    • Full refund for cancellations made more than 48 hours prior to the scheduled commencement, where no substantive preparatory work has been undertaken.

    • Partial refund, determined on a case-by-case basis, for cancellations made after substantive preparatory work has commenced but prior to full service delivery.

    • No refund for services that have been fully delivered.

  4. Procedure for Exercising the Right of Withdrawal/Cancellation

    To exercise the right of withdrawal (where applicable) or to cancel a service, the consumer must clearly communicate their decision to 42 Creative Hub™ in writing via email to support@42creativehub.com. The communication must include the consumer's name, order number, the specific product or service, and the date of purchase.

  5. Exceptions to the Right of Withdrawal

    The right of withdrawal does not apply to:

    • The supply of services if the performance has begun with the consumer’s prior express consent, and with the acknowledgement that they will lose their right of withdrawal once the service has been fully performed.

    • Services that are fully performed within the withdrawal period if the consumer has provided prior express consent and confirmation that they understand they will lose their right of withdrawal once the service is completed.

  6. Defective Digital Products

    In the event that a digital product (excluding software licenses purchased via a third party) is found to be defective or not as described upon initial delivery, consumers are entitled to remedies under applicable Irish and EU consumer protection legislation. Notification of such defects must be provided to 42 Creative Hub™ within 5 days of purchase, along with clear evidence of the defect. This clause does not apply to issues arising from the customer's subsequent modification, alteration, or cancellation of any part of the delivered digital product.
